The NCAA may be in for a fight in the courts when it comes to Todd McNair’s lawsuit against the organization, but they won a fight on a smaller scale against former USC linebacker Lamar Dawson.
Last year, Dawson filed a lawsuit against the NCAA and the Pac-12 for damages over unpaid wages and overtime. The linebacker claimed that the NCAA violated labor laws by not paying college athletes, who should be considered employees of the university.
“Leaving aside the policy question of whether and how Division I FBS college football players should be compensated, there is simply no legal basis for finding them to be ‘employees’ under the FLSA,” the Los Angeles Times quoted Judge Richard Seeborg’s decision.
