In Winston countersuit, judge dismisses one claim, upholds another

TAMPA — One of Jameis Winston’s counterclaims against Erica Kinsman was denied by a federal judge in a lawsuit alleging the rookie quarterback of the Tampa Bay Buccaneers sexually assaulted a former Florida State student in 2012.

In her ruling Tuesday in Orlando, U.S. District Court Judge Anne C. Conway turned away Kinsman’s motion to dismiss Winston’s claim of defamation. Kinsman’s motion to dismiss Winston’s claim of tortious interference was upheld.

Kinsman, who attended Zephyrhills High, filed a lawsuit alleging rape, sexual battery, assault, false imprisonment and intentional infliction of emotional distress arising out of forcible rape in state court in April.
