Yulia Efimova took bronze at the 2012 Olympics, and is a four-time World Champion in the breaststroke. The 24-year-old has also served a 16-month ban for doping and been stripped of 2013 short-course medals.
The International Olympic Committee ruled that any athlete who had served a doping ban should be ineligible for Rio, but that rule was deemed “unenforceable”.
But a decision from the CAS says the IOC and FINA will have to make the final call.
The Court of Arbitration for Sport declined Thursday to be responsible for the final decision, rejecting Efimova’s appeal to force swimming’s governing body and the IOC to accept her competing in Rio de Janeiro.
