An appeals court in Philadelphia Monday upheld the historic settlement between the National Football League and former players who sued over the league's failure to inform and protect them from the risks of potentially permanent and sometimes fatal brain injuries.
The three judges from the Third Circuit Court of Appeals said the settlement, which was approved in its current form on April 22, 2015, met the legal standard for being "fair, reasonable and adequate." Initially approved at $765 million, amendments to it raised the total potential payout to an estimated $900 million or more.
The judges said they might have wanted to see funds from the settlement divided differently, but that such judgment was not their role.
