Dayton's Pierre has reinstatement bid blocked

CINCINNATI -- A federal judge has rejected a star Dayton basketball player's request for reinstatement after his suspension linked to a sexual assault accusation.

U.S. District Judge Thomas Rose denied a motion for a temporary order that would have blocked the Ohio school's enforcement of Dyshawn Pierre's one-semester suspension for sexual harassment.

Pierre sued this month, calling the school's investigation into the female student's allegation "fundamentally unfair" with a "wholly irrational, unsubstantiated" conclusion after a hearing that didn't accommodate Pierre's learning disability.

Rose ruled Monday that Pierre hasn't suffered irreparable harm and that the public interest is served by allowing universities to carry out disciplinary procedures to keep an educational environment "free from harassment.
