A woman who claims she was raped by three Michigan State basketball players in 2015 can sue those three now-former players but not the university, MSU argued in a court filing this week.
In a motion filed in federal court in Grand Rapids, Michigan State argued that the lawsuit the woman filed earlier this year should be dismissed because it was not aware of the alleged assault and because it occurred off campus.
"While Plaintiff's assault was tragic, MSU did not cause it," the motion states. "MSU is simply not liable for the effects of an assault committed by someone else, on property not owned by MSU, and in circumstances that were not under MSU's control.
