The Santa Clara County District Attorney’s office is filing three misdemeanor charges against former 49er and new Raiders linebacker Aldon Smith stemming from his Aug. 6 arrest.
His arraignment is Oct. 6.
If convicted on all three, and if judge handed out consecutive sentences, Smith could serve maximum of 2 years, 6 months in jail.
The charges are:
1. DUI with a prior conviction and a refusal to submit to a chemical test.
2. Hit-and-run with property damage.
3. Vandalism causing less than $400 damage.
