The University of Kentucky feels like they have a trademark on the word “Kentucky” and tried to stop a small company in Whitesburg from using it on t-shirts and memorabilia.
That little company has decided to sue UK.
Kentucky Mist Moonshine has filed a lawsuit that Kentucky is a geographical location and is impossible to trademark.
The lawsuit says UK threatened legal action against Kentucky Mist Moonshine for its pursuit of a federal trademark registration.
The lawsuit contends that “Kentucky” is a geographical location and says the word has been in use since at least 1792.
