DraftKings and FanDuel are, for now, in a losing battle for their livelihood in New York, as a judge said Friday in a preliminary ruling that the two daily fantasy sports giants can't operate in the state for the time being.
New York's Attorney General Eric Schneiderman put the fight to the two companies, which Schneiderman's office has estimated the two accounts for 90 to 95 percent of the daily fantasy sports market, last month when he ordered them to stop doing business in the state. Schneiderman has contended that while daily fantasy sports games involve skill, he considers them gambling, and ultimately that they are illegal sports wagering businesses.
