The case against former Florida linebacker Daniel McMillian was dismissed May 31 due to insufficient evidence, according to court documents. He had been facing two felony charges, for sexual battery and false imprisonment.

According to State Attorney Bill Cervone, the alleged victim’s conflicting stories regarding her relationship with McMillian did not make her testimony credible.

“She changed her story regarding the nature of the relationship between the two of them,” Cervone said Thursday.

The alleged victim originally told Gainesville Police that she had a work relationship only with McMillian.
